By NC General Statutes 135-40.11(a)(5), employees and/or dependents entering the military become ineligible for coverage in the State Health Plan, but are eligible for Cobra benefits. However, the State Health Plan is abiding by the USERRA. Coverage for an individual entering the military is extended for 30 days from the induction date and then canceled at the end of the month following the 30-day extension. The reason for this is to provide individuals in the uniformed services with continuous coverage, because military coverage does not go into effect until the individual has been in active duty for 31 days.
